Litigation

Our Litigation Department gives accurate and practical legal advice.

Philosophy

Unfortunately, in many cases, litigation is simply not an economic solution. We are focused on keeping our clients out of court and obtaining the most economic solution to the dispute. We also realise that negotiation is sometimes simply not an option for clients. Where the involvement of the courts is the only option, we will thoroughly analyse the facts and the law and provide a concise litigation strategy. Where appropriate, we will move swiftly in order to protect out clients' interests or maximise the chances of success.

Who Do We Act For?

Our solicitors look after a variety of clients. The varied nature of our client base means that we act on behalf of everyone from ‘the man on the street’ to the multinational company and everyone in between.

Relationships

Our solicitors pride themselves on their strong working relationships with other solicitors and the courts. Such relationships have been built up over many years and the mutual trust and respect built facilitates discussion, negotiation and often early resolution for our clients.

Practice Areas

Our client base and practice areas have allowed our solicitors to build up expertise in a number of areas, including:

  • Professional Negligence, Shortfall Sales and Unsecured Lending Recovery for Lender Clients.
  • We work closely with our Corporate and Commercial and Conveyancing Departments. We regularly advise on Commercial and Civil Disputes. Our Leasing Department’s Landlord clients have also allowed us to gain a great deal of experience in relation to Landlord & Tenant disputes.
  • We work closely with a number of Insolvency Practitioners in North Scotland and undertake court related aspects of both Personal and Corporate Insolvency.
  • Volume Debt Recovery. Many of our trade clients issue large volumes of invoices and due to the nature of business, not all are paid. We have an efficient, streamlined system to encourage defaulters to settle.
